Is Child Protective Services a Criminal Investigatory Agency?

CPS was not designed to be a criminal investigatory agency, but it freely shares the information it gathers with the police and works closely with law enforcement. In fact, the Child’s Assessment Center, where most alleged child victims are taken in Harris County, Texas, has components of CPS and law enforcement in the same building.

If CPS Has Proposed a Safety Plan, Do I Still Need a Lawyer?

Yes! Many of our clients come to us after CPS has already done an investigation, taken statements from all members of the family, and proposed a child safety plan. The client mistakenly believed that the case resided only with CPS, and there was no need for a lawyer. CPS can refer your case to the police or prosecution if their discretion.

Awful Surprises Often Await Someone under Investigation of CPS

Don’t be surprised if you receive a phone call from a police detective even after you have fully cooperated with CPS. CPS does not have to tell you that a police investigation of possible child accusations is underway.
